1️⃣ Owner Identification

2️⃣ Nature of the platform

Faceslay is a technology platform for user generated content (UGC) that allows users to publish, share and view content, as well as interact with each other for social or informational purposes and provides only technological tools for the publication and display of content without intervening in any relationships that may arise between users. 2. No intermediation. Faceslay does not act, and shall not be interpreted as acting, as an agency, representative, intermediary, service provider, marketplace or commercial intermediation platform and does not participate in, manage, facilitate, promote or process economic transactions, payments, bookings, service engagements or commercial agreements between users. 3. Personal and non commercial use. The platform is intended exclusively for personal and non commercial use and it is strictly prohibited to use Faceslay to offer, promote, negotiate, contract or manage professional, commercial or paid services, or for any activity that involves obtaining financial benefit or any form of direct or indirect monetisation between users. 4. Prohibition of client solicitation or user diversion. Users agree not to use the platform to solicit clients, promote external services, direct other users to external channels, including social networks, messaging applications, websites, payment systems or other means, or to establish or facilitate commercial or economic relationships arising from the use of the platform. 5. User relationships. Any communication, relationship or interaction that occurs between users through the platform is carried out solely under the responsibility of those users and Faceslay is not a party to any agreement, contractual relationship or transaction that users may enter into with each other. 6. Moderation and compliance. Faceslay reserves the right, at its sole discretion and without prior notice, to remove content, limit functionalities, suspend or terminate user accounts that use the platform in a manner contrary to these conditions, particularly where use for commercial, intermediation or monetisation purposes is detected. 7. Limitation of liability. To the fullest extent permitted by applicable law, Faceslay shall not be responsible for content published by users or for any agreements, relationships or activities that users may carry out between themselves, whether within or outside the platform.

3️⃣ Registration Conditions and Minors

• The minimum age to register is 14 years old.
• Users guarantee that the information provided is truthful.
• Faceslay reserves the right to suspend or terminate accounts if violations are detected, including participation of minors.

4️⃣ Intellectual Property

• Users retain all rights over the content they post.
• By posting, they grant Faceslay a non-exclusive, worldwide, royalty-free, sublicensable license for as long as the content is available to display and operate the Platform.
• Posting content that infringes third-party rights is prohibited.

5️⃣ User Responsibility

• Users are solely responsible for the content they publish. It is strictly prohibited to post content that is illegal, defamatory, violent, sexually explicit without consent, or that infringes the rights of third parties. Faceslay does not permit users to offer, promote, negotiate, contract or manage commercial or paid services through the Platform, nor does it assume any responsibility for agreements, transactions, services or relationships that users may attempt to establish outside of the Platform. Users acknowledge that all interactions, communications or exchanges that occur between them are entirely their own responsibility and that Faceslay shall not be liable for any such activity.

6️⃣ Notice-and-Takedown Procedure (DSA)

Any user or third party may report allegedly illegal content via email to faceslay@spain.cc.

The Platform reserves the right to remove or suspend content that violates the law or these Terms.

7️⃣ Limitation of Liability

• Faceslay does not guarantee continuous availability of the Platform or the accuracy of third-party content.
• The Platform is not liable for direct or indirect damages arising from the use of third-party services or data loss.
• Faceslay’s liability is limited to the maximum extent permitted by applicable law.

8️⃣ Termination

• Users may delete their account at any time.
• Faceslay may suspend or remove accounts and content that violates these Terms or the law.
• Data will be retained as legally required.

9️⃣ Governing Law and Jurisdiction

• These Terms are governed by Spanish law.
• For consumers, mandatory rights of the user’s country of residence are respected.
• Any dispute will be submitted to the courts of Mallorca, Spain, without prejudice to non-waivable consumer rights.
